Terms and conditions of use
1. Purpose
The purpose of these general conditions of use (hereinafter referred to as the “GCU”) is to govern access to and use of the site available at www.afextrusion.com (hereinafter referred to as the “Site”) published by Aluminium Solutions Group, whose registered office is located at 19 AV GEORGE V 75008 PARIS 8, registered in the PARIS Trade and Companies Register under number 917 413 056 R.C.S. Paris (hereinafter referred to as “ALUMINIUM SOLUTIONS GROUP SAS”).
Any person who uses or visits the Site is defined below as a “User”.
When the User accesses the Site or sends an e-mail to ALUMINIUM SOLUTIONS GROUP via the Site, he acknowledges having read the GCU and accept them without restriction. These GCU prevail over all other general or particular conditions of the User. ALUMINIUM SOLUTIONS GROUP reserves the right to modify or adapt these GCU without notice by publishing a new version of them on the Site. These modifications will come into force as soon as they are put online on the Site and will therefore be enforceable against any User from that moment. The date of the update appears at the top of these GCU.
ALUMINIUM SOLUTIONS GROUP advises any person visiting the Site to save the GCU, without however modifying them.
2. Intellectual property
The Site, as well as the software, database structures, texts, information, analyses, images, photographs, graphics, logos, sounds or any other data contained on the Site remain the exclusive property of ALUMINIUM SOLUTIONS GROUP or, where applicable, of their respective owners with whom ALUMINIUM SOLUTIONS GROUP has concluded user agreements. Under no circumstances may they be reproduced, used or represented without the express written authorization of ALUMINIUM SOLUTIONS GROUP, on pain of legal proceedings.
ALUMINIUM SOLUTIONS GROUP grants the User a non-exclusive and non-transferable right to use the Site as well as the original intellectual works and data contained on the Site. The right thus granted consists of (i) a right to consult online the original intellectual works and data contained on the Site and (ii) a reproduction right consisting of a printout and/or a backup of these original intellectual works and data consulted. This right of use is for strictly private use only. All other rights are expressly reserved by ALUMINIUM SOLUTIONS GROUP.
Any other use of the Site, and in particular commercial use, by the User is prohibited without the express written authorization of ALUMINIUM SOLUTIONS GROUP.
In particular, the User undertakes not to reproduce and/or represent, download, sell, distribute, issue, translate, adapt, exploit, distribute, broadcast or communicate in whole or in part in any form whatsoever, whether or not for commercial purposes, any original intellectual work or data contained on the Site. The User also undertakes not to introduce any data onto the Site which would modify or which would be likely to modify the content or appearance of the data, the presentation or the organisation of the Site or of the works appearing on the Site, by any means whatsoever.
3. Hypertext links
The Site may contain hypertext links to other sites on the Internet. The User acknowledges that links to these other resources will cause him/her to leave the ALUMINIUM SOLUTIONS GROUP site. ALUMINIUM SOLUTIONS GROUP cannot be held responsible for the content of these sites.
Any hypertext link to the Site is formally prohibited without the express authorization of ALUMINIUM SOLUTIONS GROUP. ALUMINIUM SOLUTIONS GROUP is not responsible for hypertext links pointing to this Site.
4. Personal data
The User is informed that his registration on the Site, such as in particular to receive the newsletter or to send a request for contact, gives rise, for ALUMINIUM SOLUTIONS GROUP, to the collection and automated processing of personal data concerning him, the use of which is subject to the provisions of Law No. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties as amended (hereinafter, “Data Processing and Individual Liberties Law”).

5. Liability
The information appearing on the Site is provided on a strictly indicative basis and Aluminium Solutions Group may not be held liable in any way for the content of the information appearing on this site or for the consequences that may result from its use or interpretation.
ALUMINIUM SOLUTIONS GROUP cannot be held responsible for facts other than those relating to the publication of the Site. ALUMINIUM SOLUTIONS GROUP cannot however guarantee the exhaustiveness of its contents or the absence of modification by a third party (intrusion, virus).
ALUMINIUM SOLUTIONS GROUP in no way guarantees the availability or performance of the Site. The User may not seek the liability of ALUMINIUM SOLUTIONS GROUP on the grounds of a lost profit, loss of opportunity or turnover.
ALUMINIUM SOLUTIONS GROUP may not be held responsible for the non-operation, impossibility of access or malfunctions of the Site attributable to unsuitable equipment, malfunctions of the services of the User’s access provider or those of the Internet network.
ALUMINIUM SOLUTIONS GROUP reserves the right to interrupt access to all or part of the Site, to all or part of the Users, temporarily for maintenance reasons aimed at the proper functioning of the Site, without prior notice and without this interruption giving the User the right to any compensation whatsoever.
The User declares that he/she accepts the characteristics and limits of the Internet, and in particular acknowledges that data circulating on the Internet is not protected against possible misappropriation.
6. Miscellaneous
6.1. In the event that one of the terms of the GCU is deemed illegal or unenforceable by a court decision, the other provisions shall remain valid.
7. Applicable law – Disputes
The contract is concluded in French. These GCU and all situations arising from them are subject to French law.
IN THE EVENT OF A DISPUTE BETWEEN THE PARTIES ARISING FROM THE FORMATION, INTERPRETATION, PERFORMANCE AND/OR TERMINATION OF THE CONTRACT, AND AFTER AN ATTEMPT HAS BEEN MADE TO FIND AN AMICABLE SOLUTION, JURISDICTION IS EXPRESSLY ASSIGNED TO THE COMPETENT COURT IN AUXERRE, NOTWITHSTANDING PLURALITY OF DEFENDANTS OR THE INTRODUCTION OF THIRD PARTIES, EVEN FOR EMERGENCY PROCEEDINGS OR PROTECTIVE PROCEEDINGS OR PROCEEDINGS ON APPEAL.
